April 4, 2013 - The Romanian Parliament
Public debate on the subject: Children's rights are Law!
Parliamentary level meeting was organized by the Association of Braşov Catharsis with the Judiciary Committee of appointments, discipline, immunities and validations of the Romanian Senate.
Participants in the debate: 33 NGOs, two minors and two young victims of adoption law in force, foster parents, families that are waiting to adopt for several years, senators, deputies, state secretaries from relevant ministries,
parliamentary counselors from the specialized committees of both the Houses of Parliament.All of them supported the project made by Catharsis Association Brasov regarding the changing of adoption law in force.
Topics that were discussed:
- The repeal of the Adoption Law in force because:
- makes impossible the adoption of Romani children or those with disabilities or over the age of five years who don’t have national homing;
- discriminates Romanian and foreign families that have their usual residence in the signatory states of the Hague Convention;
- Law no. 273/2004 on the legal status of adoption,as amended and republished in November 2009 and April 2012, violates 15 articles of the Romanian Constitution and the Hague Convention concerning the
protection of children and cooperation in the area of international adoption and ignores the UN Convention regarding the rights of children.
- Improvements made by the project:
- provides a simple, clear, concise and transparent law complying the Hague Convention and ensures the early satisfaction in terms of needs of the children who are permanently deprived of parental care;
- ensures after abandonment the immediately integration of the newborn child directly into the potential adoptive family;
- the consent of adoption would be given before the court by the natural parents of the abandoned child;
- the certificate attesting the right of a family or a person to adopt children will be valid until the adoption process;
- international adoption as an alternative to domestic adoption of the children who don’t have national homing by the age of one year;
- empowering the Commission for Child Protection to take the final decision on the child’s adoption , if his relatives up to the fourth degree weren’t concerned about him on a period of six weeks after its abandonment in hospital as well as for the institutionalized children who weren’t visited by relatives up to the fourth degree in the last six months of abandonment;
- the development of public and private partnerships between Public social services and the
authorized NGOs, complying the Hague Convention.
Senator Sebastian Grapă, who made possible this public debate in the Romanian Senate, said at the end of the debate, that he wants a law which can solve promptly the abandoned child's needs.
